Texas Supreme Court flouts federal gay marriage law with a unanimous decision

In a shocking decision, the Texas State Supreme Court has ruled, 9-0, that the Obergefell decision does not guarantee same-sex spouses state benefits.  The Dallas News has a detailed story here.

The case arose from a lawsuit against Houston for extending the benefits.

It’s pretty hard to see any rational basis for this decision, other than some kind of states’ rights theory.

But it could run into the Full Faith and Credit clause.

Lambda Legal also reported this case today, with a warning about Gorsuch’s behavior on the Supreme Court so far.
